Air Passengers

Summary

1. Sutts, Strosberg LLP is working with Harrison Pensa LLP (London) and Camp Fiorante Matthews (Vancouver) to prosecute:

(a) a class action commenced in Toronto, Ontario on July 31, 2009 against Air Canada, All Nippon Airways, Asiana Airlines Inc., Cathay Pacific Airways, Delta Air Lines Inc., Japan Airlines Corporation, Qantas Airways, Singapore Airlines and United Airlines (the “Transpacific Action”);

(b) a class action commenced in Toronto, Ontario on July 31, 2009 against Air Canada, British Airways plc, Delta Air Lines Inc., Deutsche Lufthansa AG, Koninklijke Luchtvaart Maatschappij NV, Societe Air France and UAL Corporation (the “Transatlantic Action”); and

(c) a companion action commenced in Windsor, Ontario against American Airlines Inc. (the “American Action”).

2. The actions are brought on behalf of all persons in Canada, who, during the period October 1, 2001 and August 1, 2007, paid air passenger fares which included fuel, insurance and/or security surcharges for flights to or from Canada to transatlantic and transpacific destinations.

3. The plaintiffs allege that the defendants conspired and agreed among themselves, and others, to adopt and adjust the fuel, insurance and/or security surcharges included in the price of a passenger ticket for flights to or from Canada to transatlantic or transpacific destinations, as appropriate.

4. On February 3, 2010, the Ontario court approved a tolling agreement between the plaintiffs and American Airlines Inc. to hold the American Action in abeyance in return for which American Airlines will provide cooperation and produce certain documents to the plaintiffs relating to the Transpacific Action.

5. Counsel are reviewing the documents produced pursuant to the tolling agreement. Once that process is complete, the plaintiffs will ask the court to set a date for the hearing of the certification motions in the Transatlantic and the Transpacific Actions.
